What Is Wage Garnishment?

Wage garnishment is a legal procedure through which a court orders a portion of a person’s earnings to be withheld to pay a debt. If the IRS believes you have back taxes, they may decide to garnish your wages, taking a certain amount of money from each of your paychecks until the full amount you owe is paid or you set up a payment plan with the IRS.

How Much of My Wages Can the IRS Garnish?

Title III of the Consumer Credit Protection Act (CCPA) limits how much of your earnings can be garnished. The amount of earnings subject to garnishment is based on your “disposable earnings” — the amount of money left over after legally required deductions are made. These deductions may include federal and state taxes, Medicare and Social Security.

Deductions not required by law — such as health insurance and retirement plan contributions — are not typically subtracted when calculating disposable earnings.

Under Title III of the CCPA, weekly garnishment can’t exceed either 25% of your disposable earnings or the amount at which your disposable earnings are 30 times greater than minimum wage — whichever amount is less.

The best choice to solve IRS issues at a reasonable fee We received many solicitations about our tax issue. BC tax, LLC was professional and... diligent in every respect.
